Terms of business


Chargeable business advice and support (outside of Primary Authority partnership)

  1. Tailored business advice is available as a paid-for service at a rate of £99 plus VAT per hour. Some examples of services may include:
    • Bespoke food labelling advice.
    • Review of/feedback in relation to compliance of product labels.
    • Review of/feedback in relation to terms and conditions.
    • Bespoke staff training.
    • Detailed advice to help improve standard operating procedures.
    • Bespoke advice tailored to your business to aid legal compliance.
  2. The minimum charge is £49.50 plus VAT (1/2 hour).
  3. A quotation will be provided prior to any work being undertaken. 
  4. Invoices will be issued in arrears and are payable within 30 days. 
  5. A discount on the hourly rate can be obtained through a Primary Authority (PA) partnership. No VAT is payable on PA fees and charges.
  6. No charge is made for the issuing of advice leaflets or signposting to other useful materials.
  7. In the event a complaint or non-compliance is identified during a routine inspection or other similar intervention, the complaint or non-compliance will be addressed and businesses will be provided with initial advice specifying what must be done to achieve compliance and/or signposting as appropriate. If more detailed/bespoke advice is required, further support is available as set out above.

  9. Advice and/or guidance provided by Heart of the South West Trading Standards Service may not prevent enforcement action in the future.
  10. Advice and/or guidance provided by Heart of the South West Trading Standards Service may be subject to regulatory change.
  11. Duties in relation to compliance remain with the business.
  12. Except as expressly stated in this policy, all terms, conditions, warranties and representations that would otherwise be applied or implied (by statute or otherwise), or in relation to this policy are excluded to the fullest extent permissible by law.
  13. Heart of the South West Trading Standards Service’s liability to the business arising out of any paid-for services provided by us, (whether in contract, tort, negligence or otherwise), shall be limited to the amount paid by the Business for those services in any one year.
  14. In no event shall either Heart of the South West Trading Standards Service or the Business by liable to the other under or in connection with any paid for services provided by us, (whether in contract, tort, negligence or otherwise), for any indirect or consequential loss or damage, or for any of the following losses (whether direct or indirect):
    • Any loss of profits;
    • Loss of business;
    • Loss of opportunity;
    • Loss of revenue;
    • Loss of goodwill;
    • Loss of anticipated contracts; and/or
    • Loss of anticipated savings.
  15. No individual member of Heart of the South West Trading Standards Service’s staff shall have any liability to the Business, (whether in contract or in tort, including negligence), arising out of provision from Heart of the South West Trading Standards Service,  where that individual honestly believe that the act complained of was within their powers or that their duties required or entitled them to do that act and they have acted reasonably, (and the Business shall not bring any claim against such individual member of the Heart of the South West Trading Standards Service’s staff in such circumstances). 
  16. Where such information constitutes “Personal Data” the Primary Authority will act as the “processor” of the information for the purposes of the General Data Protection Regulation and the public task of the Primary Authority partnership. If such information is taken into possession appropriate security measures will be taken to safeguard such information whilst in the Primary Authority’s possession and the partner business will be advised of any data security breaches.
  17. However insofar as the Primary Authority incorporates this data into its own systems for any other legitimate purposes, such as the prevention or detection of crime, or other regulatory activity, it will be the “controller” as well as “processor” of the data. Please see our privacy notice.
